So your team just uncovered a GDPR tracking violation, a consent anomaly that, after a deeper look, turns out to be a pixel firing regardless of consent state.”
From the looks of it, itâs definitely an ePrivacy violation. But the harder question, the one you now have to race against time to answer, is whether this is also a notifiable breach under GDPR.
For that determination, you now have 72 hours.
One gets fixed with a tag manager update and a stern email to marketing. The other triggers Article 33 and supervisory authority scrutiny.

When tracking violations constitutes a personal data breach
Letâs say you had a pixel installed by marketing that mirrored health-adjacent URL paths to an ad network. The question now stands left unanswered is whether every day was a new breach, or is it a single continuous violation thatâs not documented?
Teams routinely label such tracking failures as ongoing nonâcompliance rather than âevents.â But thatâs not what regulators do. They can frame it as sustained breaches of confidentiality and transfer rules.
And that misclassification can hurt in the long run. The incident never enters the Article 33/34 pipeline, so there is no breach register entry, no risk assessment, and no notification, creating a broader obligation and exposure if a DPA later characterizes the same facts as a breach.
Article 4(12) sees unauthorized disclosure as a personal data breach
Article 4(12) defines a personal data breach as any breach of security leading to unauthorized disclosure of, or access to, personal data. That definition doesn’t require a hacker. It doesn’t require a compromised database or a malicious insider. What it requires is that personal data reached a recipient who had no legitimate basis to receive it, and that your technical or organizational measures failed to prevent that from happening.
So when a tracking pixel quietly transmits visitor identifiers, URL paths, and behavioral parameters to a third-party ad network without valid consent, that’s not just a consent failure.
It’s a potential unauthorized disclosure event. The distinction matters enormously.
EDPB further clarifies what can constitute personal data
The EDPB has made clear that online identifiers, like cookie IDs, device fingerprints, and IP addresses, qualify as personal data. You don’t need a name attached. You don’t need the data to identify someone immediately and directly.
What matters is whether identification is possible, even indirectly, even across different parties in the ecosystem. So when a pixel fires on a symptom checker page and sends a hashed user ID plus IP address, that can together reveal the identity to an advertising platform, which can also be categorized as personally identifiable data.
So, when does a tracking violation constitute a personal data breach?
Put simply, when a tag fires without valid consent and transmits personal data that includes identifiers like behavioral signals, URL paths, location patterns, to a third party that had no legitimate basis to receive it, and your technical or organisational measures failed to prevent that transmission, you have an unauthorized disclosure event under Article 4(12).
Not a consent banner problem. Not a tag management issue. A personal data breach.
The 72-hour assessment window
The 72-hour clock starts when youâre aware of the breach. The caveat? It doesnât wait for you to be fully certain to start. But it starts when you have reasonable signals that a personal data breach has occurred.
That changes how organizations need to utilize the 72-hour window. Itâs not how much time you get to investigate and achieve certainty, itâs the time within which regulators expect you to notify about the breach.
The EDPB is clear on this. Once the controllers get reasonable signals pointing to a data breach, the Article 33 obligation activates, even if the full scope remains unclear, even if your team is still pulling logs to verify the details, and even as your legal team is debating the classification.
In most cases, uncertainty doesn’t pause the clock. To regulators, only genuine uncertainty about whether a breach occurred at all can justify holding the window open a little longer.
The way you document it becomes your defense or the weakest link
The regulatory repercussions donât just come from the breach, but also from the failure to showcase your assessment timeline at all. EDPB has been clear about how authorities can sanction both failure to notify and absence of adequate security measures as separate violations.
To calculate that, regulators investigate at what moment you had reasonable certainty. Not perfect certainty. Not legal certainty. They look for âreasonableâ certainty. And they donât take your word for it.
Thatâs why your team needs to snapshot a contemporaneous record of when signals were received, how they were interpreted, and when the breach hypothesis crossed the threshold to reasonable certainty.
Article 33(5) makes documentation explicitly mandatory as well. It states how controllers need to record breaches, including all the facts and remedial actions.

How do you contain the unauthorized tracking?
Containment is a careful balance between two competing priorities: speed and precision.
One warrants you to act fast, stop the offending tracking technology, disable the tag, block the outbound calls; the other is about preserving the evidence, and a chance at pinpointing the root of the issue and the scope of damage.
Every action that stops a data flow also risks destroying the evidence you need to defend your decisions. Disable the pixel without capturing what it was doing first, and you’ve lost the record of what it transmitted, to whom, and under what page context.
That record is what your risk assessment stands on. It’s what your notification rationale references. It’s what a DPA will ask for.
The answer is doing both simultaneously
Put simply, you need to contain the damage and document the harm at the same time. So you run containment on two parallel tracks.
You pause the offending technologies, block outbound calls at CDN, WAF, or consent-mode layer, or freeze CMP configuration and script deployment pipelines. But before anything gets removed or deleted, you need to ensure that you capture the full picture and document it.
This means getting the HAR files, script code as deployed, and its CMP state at discovery.
The goal is to be able to answer questions like what data was left, who received it, how long it ran, and whether any of it touched sensitive page contexts like health or financial content.
And thatâs the key, because a pixel on a general landing page could be reading different data than the one on a webpage where it collects symptoms.
Assessing risk to data subjects
By the looks of it, individual data points like IDs, URLs, or session tokens might appear trivial. Nothing seems to directly identify anyone by name or email. And so the risk gets assessed as low, the incident gets logged as a minor compliance issue, and the notification question gets quietly shelved.
But thatâs the issue. Regulators donât assess individual data points. They look at what those data points can enable. It’s about the processing, taken in context, that can impact rights and freedoms.
A cookie ID paired with a URL path isn’t abstract. It’s a record of where someone went, when, and how often. In the hands of an ad network or data broker, it becomes something more.
The assessment is about what the data can enable
The real risk question isnât what got shared in the cookie, but it’s what the cookie can enable in the wrong hands. Thatâs what pushes a tracking incident from a non-notification incident into a notifiable breach.
Itâs about the context of the page where the tracking script fired, about who received the data, and for how long it kept happening.
Page context determines the severity of the data
Tracking that fires on health-related pages, financial calculators, or content touching religion, sexuality, or political opinion carries Article 9 sensitivity regardless of whether a named diagnosis appears in the data. So the URL alone can reveal enough.
The receiver defines the potential of misuse
An analytics provider operating under a DPA has a different risk profile than an ad network with ecosystem reach across thousands of properties. The further the data travels and the broader the recipient’s data infrastructure, the harder it is to argue that risk is contained.
The duration defines the scale of damage
A pixel that fired for two weeks across a high-traffic site is structurally different from an isolated misconfiguration caught in hours. Volume and exposure window matter.
Put simply, if a pixel was firing on a depression screening page and sending a hashed identifier plus URL to an advertising platform, the risk to data subjects is substantial, and it has to be notified as a breach.
Then, you assess and document either way.
If you conclude notification isn’t required, the reasoning has to hold up to scrutiny. If you conclude it is, the same analysis becomes the foundation of your Article 33 notification. The risk assessment is the technical record that defines how seriously you took this.
Supervisory authority notification requirements
Once you have evaluated the threshold and you figure out that a notification would be needed, Article 33 sets some minimum expectations.
You need to describe the nature of the breach, the categories and approximate number of data subjects affected, your DPO contact details, the likely consequences, and the measures taken or proposed to address it.
The name of the game is specificity. Regulators will expect pointed analysis, detailing which technologies were involved, which third parties got the data, to what extent, in what role, under what lawful basis.
Then, youâd need to document the scale scope of data. Particularly by answering the questions around the context of the page, the type of identifiers, and the duration of the gap.
Generic language like “unauthorized third-party access via cookies” without naming the parties, the data, or the context is increasingly read as a governance signal, not a disclosure.
In other words, draft it like someone who understands what happened, took it seriously, and fixed the underlying problem. That’s what defensible looks like.
Data subject notification considerations
Article 34 sits at a higher threshold than Article 33. Notification to individuals is only required when the breach is likely to result in a high risk to their rights and freedoms. That means, for tracking incidents, you are less likely to issue data subject notifications unless the context of the page where the data leak occurred was sensitive.
Location data, sensitive identifiers, exploitable information, and anything that can lead to harmful downstream consequences like racism or discrimination need to be considered for data subject notifications.
Yet, for a majority of your visitors, your business probably only looks at pseudonyms, like cookie ID, and IP. That means, thereâs no effective path to contact the person directly on the other side of the browser.
GDPR anticipates this and permits public communication where individual notification would involve disproportionate effort, provided it is equally effective. In practice, that means persistent site notices, clear incident FAQs, and likely coordination with your DPA on scope and wording.
Root cause analysis and remediation
Tracking incidents are not always limited to just the tag or the pixel that misfired. But it signals dysregulated processes. Like, skipped privacy reviews without deployment, vendor SDKs scoped too broadly, or a CMP configured without the right understanding of keywords like âlegitimate interest.â
The pixel at the center of your incident report is usually the last link in a longer chain of unchecked decisions. Regulators expect you to fix what led that tag, or the pixel to get there, and then go undetected for so long.
