HIPAA + GDPR for Global Healthcare: Overlapping Requirements and Conflicts

If your organization serves patients in both the United States and the European Union, two regulators, HIPAA and GDPR, are already watching your website. Specifically, what happens in the seconds between a visitor landing on your page and your analytics stack doing its job.

In March 2024, OCR mentioned that even unauthenticated website interactions, like a user browsing your oncology content or typing into a symptom checker, can constitute PHI if the visit is for health-related purposes. Around the same time, CNIL fined Doctissimo, a health website, €380,000 for setting non-essential cookies before users could refuse them.

Now, the highest risk object in your environment isn’t a server breach anymore, it’s a JavaScript pixel your marketing team can deploy on a Tuesday afternoon. 

And even though HIPAA and GDPR have several requirements that overlap. Complying with one doesn’t get you covered for the other. This article is about helping you navigate both.

Where HIPAA and GDPR overlap

HIPAA and GDPR were written by different regulators, in different decades, for different political contexts. Yet, they arrived at remarkably similar conclusions about what it means to handle sensitive data responsibly. Same risk-based logic. Same principle that whoever touches the data owns a piece of the obligation. Same expectation that you can demonstrate, not just assert, that your controls work. 

That overlap is the headstart for healthcare organizations operating in the US and the EU. 

Let’s look at their overlaps in detail:

Both regimes are fundamentally risk-based. 

HIPAA’s Security Rule and GDPR’s Article 32 both expect you to assess threats, implement proportionate technical and organizational controls, and document your reasoning. If you’ve been running annual risk analyses, maintaining security policies, and tracking remediation, that work translates directly into GDPR’s security expectations without significant rearchitecting.

Vendor risk management 

HIPAA and GDPR share a strict DNA of regulating how vendors can process the data, in what conditions, and under what contracts. 

For HIPAA, you need BAAs with vendors before they can even touch PHI, flowing down obligations to subcontractors. Then the business is expected to maintain a current and vetted inventory of vendors.  

This maps cleanly onto GDPR’s processor control requirements under Article 28. The names of documents might be different, HIPAA’s Business Associate Agreements versus GDPR’s Data Processing Agreements, but the underlying governance muscle is the same.

Breach response is similar.

HIPAA’s breach notification rule forces you to build incident detection, triage, risk-of-harm analysis, and breach registers into your program. GDPR Articles 33 and 34 expect exactly the same infrastructure. 

The only difference? It’s notification timing. GDPR expects you to notify a breach within 72 hours of awareness, while HIPAA has a 60-day timeline. Both GDPR and HIPAA push you to run mature incident response programs that can work like clockwork when they need to. 

Accountability follows data

Both frameworks assume that obligation travels with the relationship, not just with the data itself. HIPAA labels these relationships as covered entities and business associates. GDPR draws them as controllers and processors. Different names, same intent. 

Anyone touching regulated information on someone else’s behalf must be contractually bound and operationally supervised. Which means your vendor governance program, which includes contracts, the flow-downs, and the oversight, isn’t just HIPAA infrastructure or GDPR infrastructure. It’s both.

Minimum necessary data collection

Both frameworks push organizations to collect the least data they can to function. GDPR calls it purpose limitation, HIPAA names it the minimum necessary data. The expectation is the same: your organization must only capture what it needs for the purpose you state, and then be able to demonstrate that you did both. 

If your HIPAA program has genuinely internalized minimum necessary as a design principle rather than a checkbox, that thinking translates directly into GDPR’s Article 5 expectations without rebuilding anything.

Where HIPAA and GDPR diverge: Key conflicts and differences

While there’s overlap in intent and the outcomes, HIPAA and GDPR differ largely in enforcement. They differ in areas like notification timing, the duration companies can keep data for, and if the data can cross borders. 

And these two frameworks differ because they handle different kinds of data. For a patient, keeping PHI under authorized records isn’t the same as keeping PII on the servers of a SaaS business. 

So let’s look at all the ways they differ. 

Consent is mostly assumed under HIPAA, and earned under GDPR

Under HIPAA, most clinical and operational uses of patient data don’t require consent. Treatment, payment, and healthcare operations cover an enormous amount of ground without asking for explicit consent. And that permissive framework around PHI eliminates the friction between caregivers and the context they need to deliver quality healthcare. 

However, GDPR looks at Health data differently, demanding explicit consent under Article 9(2)(a) with real conditions. In other words, where HIPAA sees routine operations, GDPR often sees a processing activity that needs a documented legal basis before it starts.

The right to be forgotten versus the obligation to remember

One area where GDPR and HIPAA differ starkly is how they approach data retention. GDPR’s Article 17 gives individuals the right to request deletion of their personal data. But on the other hand, HIPAA expects you to keep medical records for at least six years.

Surprisingly, they still find grounds to agree on one thing, which is retaining data when it’s legally needed to. That means clinical records generally survive a deletion request.

The problem is everything else, like tracking data, marketing segments, analytics event logs, and third-party audience profiles. 

Their timing for incident response: 72 hours versus 60 days

When a breach occurs, GDPR requires notification to the supervisory authority within 72 hours of becoming aware of it. HIPAA allows up to 60 days for notification to affected individuals and HHS for breaches affecting 500 or more people.

The instinct in dual-framework shops is to wait and to investigate fully before notifying anyone. GDPR doesn’t allow that. Notification can be phased and updated as the investigation develops, but the 72-hour clock starts when you become aware, not when you finish your forensics.

Data transfers: HIPAA’s blind spot, GDPR’s sharpest edge

HIPAA barely addresses geography. As long as a Business Associate Agreement is in place, PHI can generally move where the business requires it to move. 

But when it comes to GDPR, any data that moves across the border, via cloud or other routes, has to go through a distinct legal mechanism. These typically require binding corporate rules, standard contractual clauses, and adequacy decisions.  Then, it further needs to be backed by a documented transfer impact assessment when SCCs are used.

Website compliance challenges for global healthcare

Modern websites depend on third-party scripts for dozens of functionalities. Mostly, tags, pixel trackers, and JavaScript that help marketing teams engage more customers and product teams to build better experiences. 

Yet those same trackers and pixels become the doorway for GDPR and HIPAA disclosures. 

A single marketing pixel on a symptom-checker page is now simultaneously a potential unauthorized HIPAA disclosure of PHI and an illegal transfer of health-related personal data to a third country, before you even get to questions of consent language or privacy notices.

And that’s just the beginning of the list of ways modern websites can make compliance challenging for global healthcare. Let’s take a deeper look. 

Websites need to adapt to their visitors in real time

Knowing where a visitor is from is the easy part. Acting on it isn’t. Websites need to change their consent policies, the way JavaScript and third-party trackers behave, and the way data flows through form fields on their websites to their servers. The plumbing needs to change in real-time. 

OCR’s revised March 2024 bulletin means unauthenticated visits to healthcare-related pages can generate PHI. The EDPB’s 2023 tracking guidelines mean any non-essential script touching a European visitor’s device requires prior consent before it fires. Different legal conditions. Activated and expected to be fulfilled at the same moment. For thousands and millions of customers. Across dozens of pixels, tags, and website pages. 

Tracking technology means data moving to US servers

Major adtech players, like Google and Meta, operate on US-based infrastructure. For US-based companies managing domestic traffic, that proves convenient. But at the same time, for EU users, it invokes cross-border data transfer laws.   

Every EU-to-US data flow requires either a vendor certified under the EU-US Data Privacy Framework or Standard Contractual Clauses backed by a transfer impact assessment and documented supplementary controls. 

The Irish DPC’s €1.2 billion fine against Meta was built on exactly this gap: SCCs existed, but the supplementary measures didn’t hold up. A HIPAA BAA addresses none of this. 

Cookie consent banners create friction that the US experience standards weren’t built for

If there’s one thing that GDPR can be distilled to, then it’s making exercising consent as frictionless as possible. It demands that consent must be freely given, granular, and as easy to withdraw as to grant. 

In the real world, that means refusing non-essential cookies must be as simple as accepting them. And that standard produces a consent experience that demands layered banners, purpose-by-purpose choices, and persistent preference centers. 

It’s a win for compliance, but not so much for US product teams that optimize for a frictionless experience. Marketing wants conversion. Compliance needs documented, unambiguous consent. On a site serving both audiences, those two objectives now have to coexist on the same interface, enforced differently depending on where the visitor is sitting.

Building a unified compliance approach for HIPAA and GDPR

Two regulators. Two frameworks. One website. The operational requirement is to build a single program that satisfies both without running two of everything. Here’s how you do it. 

Step 1: Default to a more restrictive yet operational approach

When it comes to tracking and consent policies, treat GDPR/ePrivacy guidelines as your global baseline. 

If you’re already gating non-essential pixels behind consent for EU users, extending that globally costs you very little and eliminates a whole category of HIPAA PHI disclosure risk in the process. Fewer unauthorized disclosures to tracking vendors. Smaller blast radius if something goes wrong.

On breach response, you adopt GDPR’s 72-hour regulator notification window as your internal escalation SLO for EU traffic. 

HIPAA’s 60-day individual notice deadline becomes a separate communications track layered on top. Yet, if you standardize 72-hour incident response practices, you operate in a state of readiness. That means one clock, one escalation path, two downstream obligations.

Step 2: Unify BAAs and DPAs in vendor agreements

The cleanest approach is a unified data protection section within your vendor contracts, with annexes that explicitly address both HIPAA’s 45 C.F.R. 164.504(e) requirements and GDPR Article 28 obligations. 

That means one document that clearly states when the vendor is acting as a HIPAA business associate, a GDPR processor, or both. Then, it spells out the obligations in each capacity. More importantly, it holds up when a regulator asks who was responsible for what.

However, one thing that organizations shouldn’t bank on is treating a strong BAA as a proxy for GDPR. They cover different universes of data, different rights obligations, and different legal bases. A vendor can be fully BAA-compliant and simultaneously operate outside your GDPR Article 28 obligations. 

Step 3: Document what regulators evaluate

To regulators, it’s always about proving exactly how a pixel behaves for this visitor, what legal basis you rely on, what contracts back this, and what risk analysis justifies the deployment.

For OCR, that means a documented inventory of every tracking technology on your properties, risk analyses that identify specific threats to ePHI for each, evidence of BAAs with vendors receiving PHI, and Security Rule safeguards that span across encryption, access controls, and monitoring applied to ePHI in motion.

For CNIL and other DPAs, it means proof that no non-essential trackers fired before consent, that refusal was as easy as acceptance, cookie lifetimes matched stated purposes, and that consent logs, configuration records, and DPIAs exist for higher-risk processing.

Step 4: Implement jurisdiction-aware consent enforcement

An EU visitor hitting your appointment scheduling page triggers GDPR and ePrivacy obligations at the first page load. At the same time, a US visitor on the same page is operating in a different legal context. 

Your system needs to know the difference before a single tag fires. Period.
